Digimon Illustration Competition Application rules

APPLICATION RULES

No purchase of Sponsor’s (defined below) products or payment of any kind is necessary to enter or win the Digimon Illustration Competition. (the“Competition”) A purchase or payment will not increase your chances of winning.

By participating in this Competition, you agree to these official Rules, so read them carefully before participating. Without limitation, these Rules provide for indemnification of the Sponsor and other Competition parties by you, a class action and jury trial waiver, a requirement that most disputes be settled by mandatory binding arbitration, and a limitation of your rights and remedies. The Sponsor may cancel your participation in case you breach any of these Rules.

The laws of Japan will govern the treatment of intellectual property rights, and the Berne Convention (Berne Convention for the Protection of Literary and Artistic Works) will govern intellectual property rights for works submitted outside of Japan.

COMPETITION PERIOD

The Competition will run from November 1, 2022, 10:00 AM Japan Standard Time ("JST") until January 16, 2023, 12:00 PM JST.
※ UTC:The Competition will run from November 1, 2022, 1:00 until January 16, 2023, 3:00.
※ PST:The Competition will run from Octobar 31, 2022, 17:00 until January 15, 2023, 19:00.
※ EST:The Competition will run from Octobar 31, 2022, 20:00 until January 15, 2023, 22:00.


Sponsors’ computer is the official time keeping device for this Competition. Please participate within the Competition Period.

SPONSOR/SUPPORTER/OPERATOR

This Competition is sponsored by Bandai Co., Ltd. (“Sponsor”) and is supported by Toei Animation Co., Ltd. (“Supporter”) and is operated by JDN Inc. (“Operator”).

ELIGIBILITY

The Competition is open only to individuals who, at the time of entry and at all times during the Competition (individually, an “Entrant,” and collectively, “Entrants”) are:


a. Those who are recognized as adults in the following countries and regions
・Japan, US,Canada, China, Hong Kong, Macau, Taiwan, UK, France, Italy, Germany, Netherlands, Spain (including states)
∙ Must be eligible to work in the jurisdiction of lawful residence
・Must be able to communicate in Japanese or English and Chinese

b. eligible to work in their jurisdiction of legal residence.


Employees, officers, and directors of Sponsor, Supporter, Operator or their respective parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, and marketing agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners. Participation constitutes Entrant’s full and unconditional agreement to these Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Competition. Participation of any other individual other than legal residents in Japan and the United States of America and participation prohibited by laws shall be invalid.

ENTRY

We want you to help us create your own unique illustration featuring one of the eight pre-selected Digimon detailed in the Digimon page(https://compe.japandesign.ne.jp/digimon-ic/en/) (“Digimon Page”) on the official website,(https://compe.japandesign.ne.jp/digimon-ic/en/character)(“Website”).


During the Competition Period, eligible Entrants can enter by visiting(https://compe.japandesign.ne.jp/digimon-ic/en/application)(the “Competition Website”) and completing the required online entry form (“Entry Form”), then uploading your original Digimon illustration as described below. You will be asked to provide the following information on the Entry Form, such as: your complete name, your group name (if available), a valid email address, your telephone number, your country/address, the name of one Digimon, its concept and other information mainly described from the Digimon Competition Content. Limit three (3) unique entries per person. You may be disqualified if you submit more than three (3) entries. Entrant must provide all required information on the Entry Form. Entrant may be asked to answer optional questions; however, you will not be disqualified whether you answer these questions or not.

SPECIFICATION

For your Submission, you should illustrate one of the pre-selected Digimon (the “Digimon Competition Content”) provided at(https://compe.japandesign.ne.jp/digimon-ic/en/character)illustrating Digimon’s glamour and world view, with the theme “Scene of Digimon’s Unique Personality or Characteristics”. For details on the Submission requirements, please refer to the materials posted on the application requirements page at (https://compe.japandesign.ne.jp/digimon-ic/en/application).


Submission must meet the following requirements. Submission without meeting such requirements shall be disqualified.

■File format: jpeg or png

■Size: W1450px x H2000px

■File capacity: Within 10MB


・In case of illustration via digital form, effect, character and back ground shall be separately layered and illustrated.

・Drawing of Digimon other than the Digimon Competition Content in the illustration shall be permitted, however, illustration of the Digimon in question from the Digimon Competition Content shall be mainly described in the composition.

※Digimon projected in the background should be limited to the Digimon provided at “Digimon Encyclopedia”(https://digimon.net/reference/)in “DIGIMONWEB” as of 23:59 on October 31, 2022 (JST).

PROHIBITIONS / CONDITIONS

<All Submissions>

・Must not include material which is or promote activities which are determined by Sponsor’s sole discretion, hateful, slanderous, libelous, tortious, sexually explicit, obscene, pornographic, inappropriate, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing; or contain material that is threatening to any person, place, business, group or world peace; or contain words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group; or contain images, words or text portraying nudity, acts of violence, or acts that are or appear to be unlawful or dangerous or in violation of, or contrary to the laws or regulations in any state where the Submission is created in their application.


・Must not contain material that violates or infringes another’s rights, including but not limited to material that violates privacy, publicity, or intellectual property rights, or that constitutes copyright infringement.


・Without limiting the foregoing, entry submissions must not include third-party trademarks, logos, insignia, location signage, photographs, artwork, or sculptures, except those of Sponsor.


・Must not include mention or performance of any copyrighted media production (including but not limited to books, articles, photographs, artwork, music, etc.) or identifying descriptions of any media property.


・Must not include third parties, including but not limited to minors, celebrities and friends, who have not expressly authorized Entrant to display their image or likeness in any submitted application or otherwise use such images or likenesses in accordance with these Rules. Entrant must be prepared to provide signed third-party authorizations upon request.


・It must not include depictions that appear to already exist in content such as animation or games, or depictions that appear to be clipped scenes from a single scene.


・Entries created using AI (Artificial Intelligence) will not be accepted.


<ENTRANTS>

Entries must be submitted by the Entrant himself/herself. Any attempt, successful or otherwise, by any Entrant to obtain more than three entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that Entrant’s entries and that Entrant may be disqualified at Sponsor’s discretion. Multiple Entrants are not permitted to share the same email address. Each Entrant is responsible for any and all costs associated with entering this Competition including but not limited to, normal internet, phone and usage charges that may be imposed by your online or phone service. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address used to enter will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider, internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.


By entering, each Entrant warrants and represents as follows:

・That his/her Submission is original,

・That his/her Submission has been created by him or her alone,

・That his/her Submission does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity,

・That he/she will not engage in any act that interferes or may interfere with the proper operation of the Competition.

・That he/she will not be any antisocial forces a crime syndicate, a member of a crime syndicate, ex-member of a crime syndicate within the last five years, quasi-member of a crime syndicate, related company of a crime syndicate, corporate racketeer, groups engaging in criminal activities under the pretext of conducting social campaign, special intelligent violent group or other equivalent persons) or encourage their activities.

・That his/her Submission complies with these Rules and the requirements above, and will not violate any federal, state or local laws or ordinances,

・That he/she shall not engage in any conduct that may cause inconvenience, disadvantage, or damage to the Sponsor or any third party.


<SPONSOR/ OPERATOR>

Proof of sending Submission will not be deemed to be proof of receipt by Sponsor and Operator. Receipt of Submission by Sponsor and Operator shall be fixed by existence of the receiving record. Sponsor reserves the right, in their sole and unfettered discretion, to disqualify any entry that they believe contains obscene, offensive or inappropriate content, that does not comply with these Rules or that is not consistent with the spirit or theme of the Competition.

GRANT OF LICENSE

Solely in connection with their participation in the Competition and limited to the duration of the Competition Period, Entrants are granted a limited, non-exclusive license to adapt, display, reproduce, and incorporate the Digimon Competition Content into their Submissions. Entrants shall only use Digimon Competition Content for purposes of entering this Competition. Entrants have no other rights to use the Digimon Competition Content and all rights arising from and to the Digimon Competition Content shall remain with the Sponsor.

JUDGING/SELECTION OF WINNER

All Submissions will be reviewed by Sponsor editorial panel to make certain the content meets the submission requirements. All Submissions that meet the requirements will be reviewed by a panel of following judges designated by the Sponsor:

First screening

Name of Entrants and his/her Submission will be announced and published in this website(https://compe.japandesign.ne.jp/digimon-ic/en/)nd DIGIMON CON on around mid-February 2023.
Number of Submissions to pass the first screening will be approximately 30~50.


Final screening

Result of the final screening will be announced on March 31, 2023.
One (1) Grand Prize, seven (7) Excellence Awards and some Judge’s Awards will be announced and published in this website(https://compe.japandesign.ne.jp/digimon-ic/en/)on March 31, 2023 (Friday).


Potential winners to pass the first screening and final screening will be advised by the Operator via e-mail. Such potential winners are required to complete and return a legal documentation that Sponsor may require for eligibility provided in these Rules, waiver of moral rights and other rights including publicity and assignment of copyrights.
Failure to return such documents by the date designated by Sponsor may result in disqualification of the prize.

Award

Grand Prize: One (1) Grand Prize winner will receive a cash value of 300,000 yen and the winners’ illustrations will be made into a Digimon card. Total approximate retail value (“ARV”) of Grand Prize is 300,000 yen.


Second Prize:Seven (7) Second Prize winners will receive a cash value of 100,000 yen each and the winners’ illustrations will be made into a Digimon card. Total ARV of Second Prize is 700,000 yen.


Judges’ Special Prize: Judges’ Special Prize winners (a few people) will receive a cash value of 50,000 yen each and the winners’ illustrations will be considered to be made into a Digimon card.

PRIZE REQUIREMENTS / RESTRICTIONS

・The winner’s illustrations of Grand Prize and Second Prizes will be eligible to be made into Digimon cards and the winner’s illustrations of Judge’s Prize will be considered to be made into Digimon cards.


・Such winners shall be requested to re-submit data file (ai, psd) of the illustrations.


・Limit one (1) prize per person and per household.


・Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of the winners.


・Prizes for winners residing in Japan may be subject to withholding income tax and special income tax for reconstruction.


・Prize cannot be substituted, assigned or transferred; however, Sponsor reserves the right to make equivalent prize substitutions at their discretion in the event any advertised prize becomes unavailable for any reason.

GENERAL CONDITIONS

・Any attempt by an Entrant or any other individual to deliberately damage any website associated with this Competition or undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to prosecute and seek damages from any such person to the fullest extent permitted by laws.


・Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision.


・Sponsor reserves the right in its sole discretion to disqualify any individual they find to violate these Rules; or to act in disruptive manner or with the intent to threaten or harass any other person.


・Sponsor and Operator, internet/wireless access providers are not responsible for any faulty, delay, lost, wrong address or insufficient postal charge of Submissions or postage articles, or technical failure or human error, or lost, delay, interruptions, disconnections, deletion, failure of data transmission or malfunction of telephone lines, computer equipment, software or combination of those hardware.


・Unreadable, incorrect or inaccurate, damaged, faking or fabricated, technically duplicated, irregular Submissions in any nature whatsoever, or any Submission not observing these Rules shall be null and void.


・Sponsor and Operator will make efforts to secure completion of this Competition, however, Sponsor and Operator shall not be responsible for any Entrant’s or other individuals’ activities relative to this Competition which include evasion of these Rules, or intervention of administration, security, fairness, completion or proper operation of this Competition.

LIMITATIONS OF LIABILITY AND
RELEASES; PUBLICITY

Sponsor and its affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional and marketing agents and their respective officers, directors, employees, representatives, and agents and Operator (the “Released Parties”) will have no liability relative to this Competition whatsoever for the following events:

・If this Competition cannot be administered or conducted or any prize cannot be awarded due to acts of God, war, or terrorism, civil unrest, strikes, supply shortages, natural disasters, weather, epidemics, compliance with any law or order of a governmental authority, or any other similar act, event, or occurrence beyond the reasonable control of the Sponsor.

・Any injuries, damages, or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages to persons, including death, or to property arising out of access to and use of this website and access to DIGIMONWEB associated with this Competition or the downloading from and/or printing material downloaded from such site.

・Any injuries, losses or damages of any kind to persons, including personal injury or death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the prize, entry, or participation in this Competition or in any Competition-related activity.

・Any claims based on publicity rights, defamation or invasion of privacy or merchandise delivery or dispute concerning payment of the Prize.

PUBLICITY AND INTELLECTUAL PROPERTY RELEASE

Except where prohibited by law, participation in the Competition constitutes Entrant’s grant to Sponsor and the Released Parties the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the Entrant’s entry, name, portrait, picture, voice, likeness, opinions and biographical information (including but not limited to hometown and state) for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without additional consideration, compensation, permission, or notification (which is confirmed in writing upon Sponsor’s request). By submitting an entry, Entrant agrees that such entry, communications or submissions, creative suggestions, ideas, notes, concepts or other materials (“Submissions”) that Entrant may submit to Sponsor or post to in connection with this Competition, including all rights embodied therein, whether sent via the website or electronic mail or some other means, with the exception of personally identifiable information as identified in Sponsor’s privacy policy (available at or https://compe.japandesign.ne.jp/digimon-ic/en/rule/privacypolicy.html ) and Operator’s privacy policy ( https://www.jdn-inc.co.jp/en/privacy.html) are deemed to be non-confidential and non-proprietary and Sponsor shall have no obligation of any kind with respect to such Submissions. Sponsor shall be free to edit, exploit, modify, publish, reproduce, use, disclose, disseminate and distribute the Submissions to others without limitation in any and all media now known or not currently known, throughout the world in perpetuity for any purpose without compensation, permission or notification to Entrant or any third- party. Entrant hereby grants to the Sponsor and its legal representatives, successors and assigns, an irrevocable, and world-wide license to use in perpetuity the submissions in any form or format and to modify the same, and acknowledges and agrees that if Sponsor uses the Submissions. Entrant shall not be entitled to any credit, consideration, notice or payments of any kind. Entrant agrees not to exercise any moral rights he or she may have to the Submissions, and agrees that if Sponsor elects to use Submissions for any purpose, all rights under copyright or other intellectual property rights which may result from that relating to Entrant’s Submissions or from use of the same by Sponsor shall be the sole property of Sponsor.

NATURE OF RELATIONSHIP / WAIVER OF EQUITABLE RELIEF

Each Entrant understands and acknowledges that Sponsor has wide access to ideas, designs, and other materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each Entrant also acknowledges that many ideas may be competitive with, similar or identical to the Submissions and/or each other in theme, idea, format or other respects. Each Entrant acknowledges and agrees that such Entrant will not be entitled to any compensation as a result of Sponsor’s use of any such similar or identical material. Each Entrant acknowledges and agrees that the Sponsor does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Submissions. Finally, each Entrant acknowledges that, with respect to any claim by Entrant relating to or arising out of Sponsor’s actual or alleged exploitation or use of any Submissions or other material submitted in connection with the Competition, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such Entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Submissions or any material based on or allegedly based on the Submissions, and the Entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.

BINDING ARBITRATION

All disputes, controversies or disagreements that may arise in connection with this Competition shall be finally settled by arbitration, and the eEntrant understands that by agreeing to arbitration, it waives its right to sue in court.

・Entrant agrees that any dispute, controversy or claim arising out of or relating to this Competition shall be resolved individually - without any form of class action - by binding arbitration (to be selected by the Sponsor in its sole and absolute discretion) The dispute or controversy shall be resolved by binding arbitration (at the sole and absolute discretion of the Sponsor) in Tokyo, Japan, in accordance with the Commercial Arbitration Rules of the Japan Commercial Arbitration Association (the "JCAA Rules").

・The Entrant confirms that the arbitration will be heard by a single arbitrator to be appointed in accordance with the JCAA Rules.

・Unless both the Entrant and Sponsor agree in writing, the arbitrator may not consolidate the claims of more than one person or otherwise preside over any form of class action or representative proceeding.

・Entrant agrees that a judgment based on the award rendered may be enforced in any court of competent jurisdiction.


※All matters relating to the Competition and these Rules shall be governed by and construed in accordance with the laws of Japan.

PRIVACY

Information collected from Entrants is subject to the Sponsor’s Privacy Policy, which can be found at(https://compe.japandesign.ne.jp/digimon-ic/en/rule/privacypolicy.html/)and the Operator’s Privacy Policy(https://www.jdn-inc.co.jp/en/privacy.html). By participating in the Competition, Entrants hereby agree to Operator’s collection and usage of their personal information in accordance with Sponsor’s and Operator’s Privacy Policies.
